Catalan government lawyers have filed an appeal against the provisional order by the High Court of Justice of Catalonia which gave president Quim Torra 48 hours to remove a banner expressing support for the Catalan "political prisoners and exiles" from the balcony of the government palace in Barcelona.
In the appeal, the lawyers call for the cautionary measure to be suspended, arguing that it violates the president's freedom of expression. They also argue that the interim decision be just that, and shouldn't consider the details of the matter.
They also note that the court's decision came with a "partially dissenting" vote from one of the judges. They argue the order was "erroneous" and that, from the point of view of the defence, a distinction needs to be drawn between exercising administrative power and demonstrations "of a political type, falling within the exercise of freedom of expression which any political representative enjoys".
The government's lawyers believe that the cautionary measure violates the Spanish Constitution, the European Convention on Human Rights and jurisprudence from the European Court of Human Rights.
